Dawai is a medication management and family health monitoring application that provides:

• Medication reminders and scheduling
• Family member notifications and monitoring
• Voice message reminders from family members
• Health vitals tracking
• Health reports and PDF exports
• Premium subscription features

3. Medical Disclaimer

• The App does not provide medical advice, diagnosis, or treatment
• Always consult qualified healthcare professionals for medical decisions
• Do not rely solely on the App for medication management
• The App does not replace professional medical judgment
• In case of medical emergency, call emergency services immediately
• We are not responsible for any health outcomes resulting from use or misuse of the App

By using Dawai, you acknowledge that you understand and accept these limitations.

4. Eligibility

You must be:

• At least 13 years old to create an account
• A parent or legal guardian to create accounts for children under 13
• Capable of forming a binding contract under applicable law

By using the App, you represent that you meet these eligibility requirements.

5. User Accounts

5.1 Account Creation

You must provide accurate, complete information when creating an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of unauthorized access

5.2 Account Security

You agree to:

• Use a strong, unique password
• Not share your account with others
• Log out from shared devices
• Enable security features when available

6. Subscription and Payments

• Up to 3 medications
• 1 family member (view-only)

6.5 Billing and Renewal

• Subscriptions automatically renew unless canceled
• You will be charged at the start of each billing period
• Prices may change with 30 days notice
• Billing is handled through Apple App Store or Google Play Store
• Refunds are subject to Apple and Google's refund policies

6.6 Cancellation

You can cancel your subscription at any time:

• Through the App settings
• Through Apple App Store or Google Play Store settings
• Cancellation takes effect at the end of the current billing period
• You retain access to Premium features until the end of the paid period
• No refunds for partial months

6.7 Family Member Access

When a Premium user invites family members:

• Family members receive free full access without separate subscription
• Access continues as long as the Premium user maintains subscription
• If Premium subscription ends, family member access reverts to free tier limitations

7. User Content and Conduct

7.1 Your Content

You retain ownership of all content you provide (medications, vitals, voice recordings, photos). By using the App, you grant us a license to:

• Store and process your content to provide services
• Share content with family members you invite
• Create backups and ensure data availability

7.2 Prohibited Conduct

You agree NOT to:

• Provide false or misleading information
• Impersonate any person or entity
• Use the App for illegal purposes
• Attempt to gain unauthorized access to systems
• Reverse engineer, decompile, or disassemble the App
• Upload viruses, malware, or harmful code
• Harass, abuse, or harm other users
• Use the App to spam or send unsolicited communications

8. Intellectual Property

The App and all its contents (text, graphics, logos, software, features) are owned by Dawai and protected by intellectual property laws. You may not:

• Copy, modify, or create derivative works
• Distribute, sell, or lease any part of the App
• Use our trademarks without written permission
• Remove copyright or proprietary notices

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICE
• UNINTERRUPTED OR ERROR-FREE OPERATION
• MEDICAL ACCURACY OR HEALTH OUTCOMES

WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR THAT DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS
• WE ARE NOT LIABLE FOR HEALTH OUTCOMES, MISSED MEDICATIONS, OR MEDICAL DECISIONS
• WE ARE NOT RESPONSIBLE FOR THIRD-PARTY SERVICES (Apple, Google, Payment Processors)

11. Indemnification

You agree to indemnify and hold harmless Dawai, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or conduct

12. Termination

12.1 By You

You may terminate your account at any time by using the Delete Account feature or contacting support.

12.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the service or other users
• Fail to pay subscription fees

12.3 Effect of Termination

Upon termination:

• Your access to the App will cease immediately
• Your data will be deleted per our Privacy Policy
• No refunds will be provided for remaining subscription period
• Sections that should survive termination (e.g., Disclaimer, Limitation of Liability) will remain in effect

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the App
• Sending email notification
• Displaying in-app notification

Your continued use after changes constitutes acceptance. If you do not agree to changes, you must stop using the App and cancel your subscription.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the Kingdom of Saudi Arabia without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising from these Terms or use of the App will be resolved through:

1. Informal negotiation (contact info@dawaiapp.com)
2. Binding arbitration if negotiation fails
3. Small claims court (if eligible)

14.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or class arbitrations.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dawai.

15.2 Severability

If any provision is found unenforceable, the remaining provisions will remain in effect.

15.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

15.4 Assignment

You may not assign these Terms. We may assign our rights and obligations without restriction.

15.5 Third-Party Services

The App may integrate with third-party services (Apple Health, payment processors). Your use of these services is subject to their respective terms and policies.

بإنشاء حساب أو استخدام دوائي، فإنك تقر بأنك قرأت وفهمت ووافقت على الالتزام بهذه الشروط وسياسة الخصوصية الخاصة بنا. إذا كنت لا توافق، فلا تستخدم التطبيق.

2. وصف الخدمة

دوائي هو تطبيق لإدارة الأدوية ومراقبة صحة العائلة يوفر:

• تذكيرات الأدوية والجدولة
• إشعارات ومراقبة أفراد العائلة
• تذكيرات برسائل صوتية من أفراد العائلة
• تتبع العلامات الحيوية
• التقارير الصحية وتصدير PDF
• ميزات الاشتراك المميز

3. إخلاء المسؤولية الطبية

• التطبيق لا يقدم نصائح طبية أو تشخيصاً أو علاجاً
• استشر دائماً المتخصصين المؤهلين في الرعاية الصحية للقرارات الطبية
• لا تعتمد على التطبيق وحده لإدارة الأدوية
• التطبيق لا يحل محل الحكم الطبي المهني
• في حالة الطوارئ الطبية، اتصل بخدمات الطوارئ فوراً
• لسنا مسؤولين عن أي نتائج صحية ناتجة عن استخدام التطبيق أو سوء استخدامه

باستخدامك لدوائي، فإنك تقر بأنك تفهم وتقبل هذه القيود.

4. الأهلية

يجب أن تكون:

• عمرك 13 عاماً على الأقل لإنشاء حساب
• والداً أو وصياً قانونياً لإنشاء حسابات للأطفال دون 13 عاماً
• قادراً على إبرام عقد ملزم بموجب القانون المعمول به

باستخدام التطبيق، فإنك تصرح بأنك تستوفي متطلبات الأهلية هذه.

5. حسابات المستخدمين

5.1 إنشاء الحساب

يجب تقديم معلومات دقيقة وكاملة عند إنشاء حساب. أنت مسؤول عن:

• الحفاظ على سرية بيانات اعتماد حسابك
• جميع الأنشطة التي تتم تحت حسابك
• إخطارنا فوراً بأي وصول غير مصرح به

5.2 أمان الحساب

أنت توافق على:

• استخدام كلمة مرور قوية وفريدة
• عدم مشاركة حسابك مع الآخرين
• تسجيل الخروج من الأجهزة المشتركة
• تفعيل ميزات الأمان عند توفرها

6. الاشتراك والمدفوعات

6.1 المستوى المجاني

يوفر التطبيق مستوى مجانياً بميزات محدودة:

• حتى 3 أدوية
• فرد عائلة واحد (عرض فقط)
• تذكيرات أدوية قياسية
• تتبع محدود للعلامات الحيوية (نوعان)

6.2 الاشتراك المميز

• التقارير الصحية وتصدير PDF
• دعم عملاء أولوية

6.4 الفترة التجريبية المجانية

• يحصل المستخدمون الجدد على فترة تجريبية مجانية لمدة 14 يوماً للميزات المميزة
• لا رسوم خلال الفترة التجريبية
• يمكنك الإلغاء في أي وقت قبل انتهاء الفترة التجريبية لتجنب الرسوم
• يبدأ الاشتراك تلقائياً بعد الفترة التجريبية ما لم يتم الإلغاء

6.5 الفوترة والتجديد

• تتجدد الاشتراكات تلقائياً ما لم يتم إلغاؤها
• سيتم تحصيل الرسوم في بداية كل فترة فوترة
• قد تتغير الأسعار مع إشعار مسبق بـ 30 يوماً
• تتم الفوترة من خلال Apple App Store أو Google Play Store
• تخضع المبالغ المستردة لسياسات استرداد Apple و Google

6.6 الإلغاء

يمكنك إلغاء اشتراكك في أي وقت:

• من خلال إعدادات التطبيق
• من خلال إعدادات Apple App Store أو Google Play Store
• يسري الإلغاء في نهاية فترة الفوترة الحالية
• تحتفظ بالوصول إلى الميزات المميزة حتى نهاية الفترة المدفوعة
• لا استرداد للأشهر الجزئية

6.7 وصول أفراد العائلة

عندما يدعو مستخدم مميز أفراد العائلة:

• يحصل أفراد العائلة على وصول كامل مجاني بدون اشتراك منفصل
• يستمر الوصول طالما يحافظ المستخدم المميز على اشتراكه
• إذا انتهى الاشتراك المميز، يعود وصول أفراد العائلة إلى قيود المستوى المجاني

7. محتوى المستخدم والسلوك

7.1 محتواك

تحتفظ بملكية جميع المحتوى الذي تقدمه (الأدوية، العلامات الحيوية، التسجيلات الصوتية، الصور). باستخدامك للتطبيق، تمنحنا ترخيصاً لـ:

• تخزين ومعالجة محتواك لتقديم الخدمات
• مشاركة المحتوى مع أفراد العائلة الذين تدعوهم
• إنشاء نسخ احتياطية وضمان توفر البيانات

7.2 السلوك المحظور

أنت توافق على عدم:

• تقديم معلومات كاذبة أو مضللة
• انتحال شخصية أي شخص أو كيان
• استخدام التطبيق لأغراض غير قانونية
• محاولة الوصول غير المصرح به إلى الأنظمة
• الهندسة العكسية أو تفكيك أو فك تجميع التطبيق
• تحميل فيروسات أو برامج ضارة
• مضايقة أو إساءة معاملة المستخدمين الآخرين
• استخدام التطبيق للرسائل المزعجة أو الاتصالات غير المرغوب فيها

8. الملكية الفكرية

التطبيق وجميع محتوياته (النصوص، الرسومات، الشعارات، البرمجيات، الميزات) مملوكة لدوائي ومحمية بقوانين الملكية الفكرية. لا يجوز لك:

• نسخ أو تعديل أو إنشاء أعمال مشتقة
• توزيع أو بيع أو تأجير أي جزء من التطبيق
• استخدام علاماتنا التجارية بدون إذن كتابي
• إزالة إشعارات حقوق النشر أو الملكية

9. إخلاء المسؤولية عن الضمانات

يُقدم التطبيق "كما هو" و"حسب التوفر" بدون أي ضمانات من أي نوع، صريحة أو ضمنية، بما في ذلك على سبيل المثال لا الحصر:

• القابلية للتسويق أو الملاءمة لغرض معين
• دقة أو موثوقية أو توفر الخدمة
• التشغيل المتواصل أو الخالي من الأخطاء
• الدقة الطبية أو النتائج الصحية

لا نضمن أن التطبيق سيلبي متطلباتك أو أن العيوب سيتم تصحيحها.

10. تحديد المسؤولية

إلى أقصى حد يسمح به القانون:

• لسنا مسؤولين عن أي أضرار غير مباشرة أو عرضية أو خاصة أو تبعية أو عقابية
• لن تتجاوز مسؤوليتنا الإجمالية المبلغ الذي دفعته في الأشهر الـ 12 الماضية
• لسنا مسؤولين عن النتائج الصحية أو الأدوية الفائتة أو القرارات الطبية
• لسنا مسؤولين عن خدمات الطرف الثالث (Apple، Google، معالجات الدفع)

11. التعويض

أنت توافق على تعويض وحماية دوائي ومسؤوليها ومديريها وموظفيها ووكلائها من أي مطالبات أو أضرار أو خسائر أو مسؤوليات ونفقات (بما في ذلك الرسوم القانونية) الناشئة عن:

• استخدامك أو سوء استخدامك للتطبيق
• انتهاكك لهذه الشروط
• انتهاكك لأي حقوق لطرف آخر
• محتواك أو سلوكك

12. الإنهاء

12.1 من قبلك

يمكنك إنهاء حسابك في أي وقت باستخدام ميزة حذف الحساب أو الاتصال بالدعم.

12.2 من قبلنا

قد نعلق أو ننهي حسابك إذا:

• انتهكت هذه الشروط
• شاركت في نشاط احتيالي
• أسأت استخدام الخدمة أو أضررت بالمستخدمين الآخرين
• فشلت في دفع رسوم الاشتراك

12.3 أثر الإنهاء

عند الإنهاء:

• سيتوقف وصولك إلى التطبيق فوراً
• سيتم حذف بياناتك وفقاً لسياسة الخصوصية
• لن يتم تقديم استرداد لفترة الاشتراك المتبقية
• ستظل الأقسام التي يجب أن تبقى سارية بعد الإنهاء (مثل إخلاء المسؤولية، تحديد المسؤولية) نافذة

13. التغييرات على الشروط

نحتفظ بالحق في تعديل هذه الشروط في أي وقت. سنخطرك بالتغييرات الجوهرية عن طريق:

• نشر الشروط المحدثة في التطبيق
• إرسال إشعار بالبريد الإلكتروني
• عرض إشعار داخل التطبيق

استمرارك في الاستخدام بعد التغييرات يعني القبول. إذا كنت لا توافق على التغييرات، يجب عليك التوقف عن استخدام التطبيق وإلغاء اشتراكك.

14. القانون الحاكم وحل النزاعات

14.1 القانون الحاكم

تخضع هذه الشروط لقوانين المملكة العربية السعودية بغض النظر عن مبادئ تعارض القوانين.

14.2 حل النزاعات

سيتم حل أي نزاعات ناشئة عن هذه الشروط أو استخدام التطبيق من خلال:

1. التفاوض غير الرسمي (اتصل بـ info@dawaiapp.com)
2. التحكيم الملزم إذا فشل التفاوض
3. محكمة المطالبات الصغيرة (إذا كانت مؤهلة)

14.3 التنازل عن الدعوى الجماعية

أنت توافق على حل النزاعات بشكل فردي والتنازل عن الحق في المشاركة في الدعاوى الجماعية أو التحكيم الجماعي.

15. أحكام متنوعة

15.1 الاتفاقية الكاملة

تشكل هذه الشروط، مع سياسة الخصوصية، الاتفاقية الكاملة بينك وبين دوائي.

15.2 قابلية الفصل

إذا تبين أن أي حكم غير قابل للتنفيذ، تظل الأحكام المتبقية سارية المفعول.

15.3 عدم التنازل

عدم إنفاذنا لأي حق أو حكم لا يشكل تنازلاً عن ذلك الحق.

15.4 التنازل

لا يجوز لك التنازل عن هذه الشروط. يجوز لنا التنازل عن حقوقنا والتزاماتنا بدون قيود.

15.5 خدمات الطرف الثالث

قد يتكامل التطبيق مع خدمات الطرف الثالث (Apple Health، معالجات الدفع). يخضع استخدامك لهذه الخدمات لشروطها وسياساتها الخاصة.
